Federal Judge Blocks Biden's Healthcare Worker Vaccine Mandate

In Brief: 

On Tuesday, a federal judge in the state of Louisiana blocked the Biden administration’s vaccine mandate for healthcare workers. The judge’s injunction covers the entire country, going farther than his Missouri colleague’s injunction on Monday that only covered 10 states. The judge’s decision rested in the fact that Biden was overstepping his constitutional powers saying, "During a pandemic such as this one, it is even more important to safeguard the separation of powers set forth in our Constitution to avoid erosion of our liberties."

The Background: 

Biden’s regulation would have required workers at medical facilities that participate in government programs like Medicare and Medicaid to be fully vaccinated by January 4th. The regulation covered 17 million workers and would have caused major staffing issues for hospitals across the country.

The lawsuit was brought by Louisiana Attorney General Jeff Landry along with 13 other states. 

Judge Terry Doughty of Louisiana’s Western District made the determination. In his ruling, Judge Doughty made much of the fact that the executive branch doesn’t have the authority to issue rulings. He also called out the Biden administration’s “indefinite state of emergency” saying, “If human nature and history teach anything, it is that civil liberties face grave risks when governments proclaim indefinite states of emergency.”

Any appeals of the ruling will go to the 5th U.S. Circuit Court of Appeals, which already blocked a similar vaccine mandate for businesses with 100 or more employees.

Doughty admitted that a higher court would ultimately decide the fate of this case, but that it is important to maintain the “status quo” because of the “liberty interests of the unvaccinated.”
