Federal Judge Blocks Biden, Protects Athletes

In Brief: 

A U.S. District Court in Tennessee has temporarily barred the Biden administration from enforcing a policy that would have required states to allow athletes who identify as transgender to play on the sports teams of the gender they identify with, as well as enter the locker rooms and bathrooms of their choice. 

The Background:

On Friday, U.S. District Judge Charles Atchley Jr. ruled in favor of twenty state attorneys general who sued the Biden administration in August 2021, the Associated Press reported. This comes as UPenn has nominated a biological male for the NCAA Woman of the Year Award. The award was established in 1991 to recognize “female student-athletes who have exhausted their eligibility and distinguished themselves in their community, in athletics and in academics throughout their college careers.” 

Thomas, 22, the biological male nominated by UPenn, was a failing athlete while competing in men’s sports up until 2019. Thomas then decided to compete as a woman while notably still having anatomically male parts and no transition surgery planned. As a biological male competing against biological females, Thomas has a notable bone and muscle density advantage, making a fair competition impossible. 

Despite numerous complaints of unfairness, Thomas continues to dominate female sports, all while fellow teammates are being bullied, shut down, and called a hateful person or transphobic, by their own school when voicing concerns.
